Privacy policy

This Privacy policy informs you about the nature, scope and purpose of the processing of personal data (hereinafter "data") within our online offering and the websites, functions and content associated with it, as well as external online presences, such as our social media profiles (hereinafter jointly referred to as the "online offering"). With regard to the terms used, such as "processing" or "controller", we refer to the definitions in Art. 4 of the General Data Protection Regulation (GDPR).

Terms Used

"Personal data" means any information relating to an identified or identifiable natural person (hereinafter "data subject"); an identifiable natural person is one who can be identified, directly or indirectly, in particular by reference to an identifier such as a name, an identification number, location data, an online identifier (e.g. cookie) or to one or more factors specific to the physical, physiological, genetic, mental, economic, cultural or social identity of that natural person.

"Processing" means any operation or set of operations performed on personal data, whether or not by automated means. The term is broad and covers practically any handling of data.

"Controller" means the natural or legal person, public authority, agency or other body which, alone or jointly with others, determines the purposes and means of the processing of personal data.

Relevant Legal Bases

In accordance with Art. 13 GDPR, we inform you of the legal bases of our data processing. If the legal basis is not stated in the privacy policy, the following applies: The legal basis for obtaining consent is Art. 6 (1) lit. a and Art. 7 GDPR, the legal basis for processing to fulfill our services and carry out contractual measures as well as to respond to inquiries is Art. 6 (1) lit. b GDPR, the legal basis for processing to fulfill our legal obligations is Art. 6 (1) lit. c GDPR, and the legal basis for processing to protect our legitimate interests is Art. 6 (1) lit. f GDPR. In the event that vital interests of the data subject or another natural person require the processing of personal data, Art. 6 (1) lit. d GDPR serves as the legal basis.

Security Measures

We ask you to inform yourself regularly about the content of our privacy policy. We adapt the privacy policy as soon as changes to the data processing we carry out make this necessary. We will inform you as soon as the changes require an act of cooperation on your part (e.g. consent) or other individual notification.

If, in the course of our processing, we disclose data to other persons and companies (processors or third parties), transmit it to them or otherwise grant them access to the data, this is done only on the basis of legal permission (e.g. if transmission of the data to third parties, such as payment service providers, is necessary for the performance of a contract pursuant to Art. 6 (1) lit. b GDPR), if you have consented, if a legal obligation provides for this, or on the basis of our legitimate interests (e.g. when using agents, web hosts, etc.).
If we commission third parties to process data on the basis of a so-called "data processing agreement", this is done on the basis of Art. 28 GDPR.

Transfers to Third Countries

If we process data in a third country (i.e. outside the European Union (EU) or the European Economic Area (EEA)) or if this happens in the context of using third-party services or disclosing or transmitting data to third parties, this only occurs if it is done to fulfill our (pre-)contractual obligations, on the basis of your consent, due to a legal obligation or on the basis of our legitimate interests. Subject to legal or contractual permissions, we process or have the data processed in a third country only if the special requirements of Art. 44 et seq. GDPR are met. This means the processing takes place, for example, on the basis of special guarantees, such as the officially recognized determination of a level of data protection corresponding to that of the EU (e.g. for the USA through the "Privacy Shield") or compliance with officially recognized special contractual obligations (so-called "standard contractual clauses").

Rights of Data Subjects

You have the right to request confirmation as to whether the data in question is being processed and to information about this data as well as further information and a copy of the data in accordance with Art. 15 GDPR.
In accordance with Art. 16 GDPR, you have the right to request the completion of the data concerning you or the rectification of inaccurate data concerning you.
In accordance with Art. 17 GDPR, you have the right to demand that the data in question be deleted without delay, or alternatively, in accordance with Art. 18 GDPR, to demand a restriction of the processing of the data.
You have the right to demand that the data concerning you that you have provided to us be received in accordance with Art. 20 GDPR and to request its transmission to other controllers.
Furthermore, in accordance with Art. 77 GDPR, you have the right to lodge a complaint with the competent supervisory authority.

Right of Withdrawal

You have the right to withdraw consent given in accordance with Art. 7 (3) GDPR with effect for the future

Right to Object

You can object to the future processing of the data concerning you in accordance with Art. 21 GDPR at any time. The objection can be made in particular against processing for the purposes of direct marketing.

Cookies and Right to Object to Direct Marketing

"Cookies" are small files that are stored on users' computers. Various information can be stored within the cookies. A cookie primarily serves to store information about a user (or the device on which the cookie is stored) during or after their visit to an online offering. Temporary cookies, or "session cookies" or "transient cookies", are cookies that are deleted after a user leaves an online offering and closes their browser. Such a cookie can store, for example, the contents of a shopping cart in an online shop or a login status.
Cookies are referred to as "permanent" or "persistent" if they remain stored even after the browser is closed. For example, the login status can be saved when users visit again after several days. The interests of users used for reach measurement or marketing purposes can also be stored in such a cookie.
"Third-party cookies" are cookies offered by providers other than the controller who operates the online offering (otherwise, if they are only the controller's cookies, they are called "first-party cookies").

We currently do not use any cookies on the Gottes Haus website that require the user's consent. Only the necessary temporary session cookies for this website and the donation page are set.

Deletion of Data

The data processed by us will be deleted or restricted in its processing in accordance with Art. 17 and 18 GDPR. Unless expressly stated within this privacy policy, the data stored by us will be deleted as soon as it is no longer required for its intended purpose and no legal retention obligations prevent its deletion. If the data is not deleted because it is required for other legally permissible purposes, its processing will be restricted. This means the data is blocked and not processed for other purposes. This applies, for example, to data that must be retained for commercial or tax law reasons.
According to legal requirements in Germany, retention takes place in particular for 6 years in accordance with Section 257 (1) HGB (commercial books, inventories, opening balance sheets, annual financial statements, commercial letters, accounting vouchers, etc.) and for 10 years in accordance with Section 147 (1) AO (books, records, management reports, accounting vouchers, commercial and business letters, documents relevant for taxation, etc.).
According to legal requirements in Austria, retention takes place in particular for 7 years in accordance with Section 132 (1) BAO (accounting documents, receipts/invoices, accounts, vouchers, business papers, statement of income and expenses, etc.), for 22 years in connection with real estate and for 10 years for documents in connection with electronically provided services, telecommunications, broadcasting and television services provided to non-entrepreneurs in EU member states and for which the Mini-One-Stop-Shop (MOSS) is used.

Hosting

The hosting services we use serve to provide the following services: infrastructure and platform services, computing capacity, storage space and database services, security services and technical maintenance services that we use for the purpose of operating this online offering.
In doing so, we, or our hosting provider, process inventory data, contact data, content data, contract data, usage data, meta and communication data of customers, interested parties and visitors of this online offering on the basis of our legitimate interests in an efficient and secure provision of this online offering in accordance with Art. 6 (1) lit. f GDPR in conjunction with Art. 28 GDPR (conclusion of a data processing agreement).

Collection of Access Data and Log Files

We, or our hosting provider, collect data on every access to the server on which this service is located (so-called server log files) on the basis of our legitimate interests within the meaning of Art. 6 (1) lit. f GDPR. The access data includes the name of the website accessed, file, date and time of access, amount of data transferred, notification of successful access, browser type and version, the user's operating system, referrer URL (the previously visited page), IP address and the requesting provider.
Log file information is stored for security reasons (e.g. to investigate misuse or fraud) for a maximum of 7 days and then deleted. Data whose further retention is required for evidentiary purposes is exempt from deletion until the respective incident has been finally clarified.

Provision of Our Statutory and Business Services

We process the data of our members, supporters, interested parties, customers or other persons in accordance with Art. 6 (1) lit. b GDPR insofar as we offer them contractual services or act within the framework of an existing business relationship, e.g. towards members, or are ourselves recipients of services and benefits. Otherwise, we process the data of data subjects in accordance with Art. 6 (1) lit. f GDPR on the basis of our legitimate interests, e.g. when it concerns administrative tasks or public relations work.
The data processed in this context, the nature, scope and purpose and the necessity of its processing are determined by the underlying contractual relationship. This basically includes inventory and master data of the persons (e.g. name, address, etc.), as well as contact data (e.g. e-mail address, telephone, etc.), contract data (e.g. services used, content and information communicated, names of contact persons) and, if we offer paid services or products, payment data (e.g. bank details, payment history, etc.).
We delete data that is no longer required for the provision of our statutory and business purposes. This is determined according to the respective tasks and contractual relationships. In the case of business processing, we retain the data for as long as it may be relevant for business transactions, as well as with regard to any warranty or liability obligations. The necessity of retaining the data is reviewed every three years; otherwise, the statutory retention obligations apply.

Order Processing in the Online Shop and Customer Account

We process the data of our customers as part of the ordering processes in our online shop to enable them to select and order the chosen products and services, as well as their payment and delivery or execution.
The processed data includes inventory data, communication data, contract data, payment data, and the persons affected by the processing include our customers, interested parties and other business partners. The processing takes place for the purpose of providing contractual services in the context of operating an online shop, billing, delivery and customer services. In this context, we use session cookies to store the shopping cart contents and permanent cookies to store the login status.
The processing takes place on the basis of Art. 6 (1) lit. b (execution of ordering processes) and c (legally required archiving) GDPR. The information marked as required is necessary for the establishment and fulfillment of the contract. We disclose the data to third parties only in the context of delivery, payment or within the framework of legal permissions and obligations towards legal advisers and authorities. The data is processed in third countries only if this is necessary for the fulfillment of the contract (e.g. at the customer's request for delivery or payment).
Users can optionally create a user account in which they can view their orders in particular. As part of the registration, the required mandatory information is communicated to the users. The user accounts are not public and cannot be indexed by search engines. If users have terminated their user account, their data with regard to the user account will be deleted, subject to its retention being necessary for commercial or tax law reasons in accordance with Art. 6 (1) lit. c GDPR. Information in the customer account remains until its deletion with subsequent archiving in the event of a legal obligation. It is the responsibility of the users to back up their data before the end of the contract in the event of termination.
As part of registration and renewed logins as well as use of our online services, we store the IP address and the time of the respective user action. The storage takes place on the basis of our legitimate interests, as well as the users' interests in protection against misuse and other unauthorized use. This data is generally not passed on to third parties unless it is necessary to pursue our claims or there is a legal obligation to do so in accordance with Art. 6 (1) lit. c GDPR.
Deletion takes place after the expiry of statutory warranty and comparable obligations; the necessity of retaining the data is reviewed every three years; in the case of statutory archiving obligations, deletion takes place after their expiry (end of commercial law (6 years) and tax law (10 years) retention obligation).

Comments and Contributions

If users leave comments or other contributions, their IP addresses may be stored for 7 days on the basis of our legitimate interests within the meaning of Art. 6 (1) lit. f GDPR. This is done for our security in case someone leaves unlawful content in comments and contributions (insults, prohibited political propaganda, etc.). In this case, we ourselves can be prosecuted for the comment or contribution and are therefore interested in the identity of the author.
Furthermore, we reserve the right, on the basis of our legitimate interests in accordance with Art. 6 (1) lit. f GDPR, to process user information for the purpose of spam detection.

Newsletter

With the following notes, we inform you about the contents of our newsletter as well as the registration, dispatch and statistical evaluation procedures and your rights of objection. By subscribing to our newsletter, you agree to receive it and to the procedures described.
Content of the newsletter: We send newsletters, e-mails and other electronic notifications with promotional information (hereinafter "newsletter") only with the consent of the recipients or a legal permission. Insofar as the contents of the newsletter are specifically described in the context of a registration, they are decisive for the consent of the users. Otherwise, our newsletters contain information about our services and us.
Double opt-in and logging: Registration for our newsletter takes place in a so-called double opt-in procedure. This means that after registration you will receive an e-mail asking you to confirm your registration. This confirmation is necessary so that no one can register with someone else's e-mail address. Registrations for the newsletter are logged in order to be able to prove the registration process in accordance with legal requirements. This includes storing the time of registration and confirmation, as well as the IP address. Changes to your data stored by the dispatch service provider are also logged.
Registration data: To register for the newsletter, it is sufficient to provide your e-mail address. Optionally, we ask you to provide a name for the purpose of personal address in the newsletter.
Germany: The dispatch of the newsletter and the associated performance measurement take place on the basis of the recipients' consent in accordance with Art. 6 (1) lit. a, Art. 7 GDPR in conjunction with Section 7 (2) No. 3 UWG or on the basis of legal permission in accordance with Section 7 (3) UWG.
The logging of the registration procedure takes place on the basis of our legitimate interests in accordance with Art. 6 (1) lit. f GDPR. Our interest is directed towards the use of a user-friendly and secure newsletter system that serves both our business interests and the expectations of the users and also allows us to prove consent.
Termination/withdrawal – You can terminate the receipt of our newsletter at any time, i.e. withdraw your consent. You will find a link to cancel the newsletter at the end of each newsletter. We may store the unsubscribed e-mail addresses for up to three years on the basis of our legitimate interests before deleting them, in order to be able to prove consent that was previously given. The processing of this data is limited to the purpose of a possible defense against claims. An individual request for deletion is possible at any time, provided that the former existence of consent is confirmed at the same time.

Newsletter – Dispatch Service Provider 

The newsletter is sent via the dispatch service provider Brevo, 1402 Third Avenue, #301, Seattle, WA 98101. You can view the privacy policy of the dispatch service provider here: https://www.brevo.com/legal/privacypolicy/ The dispatch service provider is used on the basis of our legitimate interests in accordance with Art. 6 (1) lit. f GDPR and a data processing agreement in accordance with Art. 28 (3) sentence 1 GDPR. The dispatch service provider may use the recipients' data in pseudonymous form, i.e. without assignment to a user, to optimize or improve its own services, e.g. for technical optimization of the dispatch and presentation of the newsletter or for statistical purposes. However, the dispatch service provider does not use the data of our newsletter recipients to contact them itself or to pass the data on to third parties.

Google Analytics

Google Analytics is currently not used for the Gottes Haus website.

Online Presences in Social Media

We maintain online presences within social networks and platforms in order to communicate with the customers, interested parties and users active there and to inform them about our services. When accessing the respective networks and platforms, the terms and conditions and data processing guidelines of their respective operators apply.
Unless otherwise stated in our privacy policy, we process the data of users if they communicate with us within the social networks and platforms, e.g. write posts on our online presences or send us messages.

Integration of Third-Party Services and Content

Within our online offering, on the basis of our legitimate interests (i.e. interest in the analysis, optimization and economic operation of our online offering within the meaning of Art. 6 (1) lit. f GDPR), we use content or service offerings from third-party providers in order to integrate their content and services, such as videos or fonts (hereinafter uniformly referred to as "content").
This always presupposes that the third-party providers of this content perceive the IP address of the users, since without the IP address they could not send the content to their browser. The IP address is therefore required for the display of this content. We endeavor to use only content whose respective providers use the IP address solely for the delivery of the content.

YouTube

We embed the videos of the platform "YouTube" of the provider Google LLC, 1600 Amphitheatre Parkway, Mountain View, CA 94043, USA. These YouTube videos are embedded with the NoCookie URL (www.youtube-nocookie.com) and do not set any cookies.
